Child custody is decided by a court based on factors in Minnesota Statutes Section 518.17. If you were not married to the mother of your child at birth, Minnesota law requires unmarried fathers to obtain a Court Order signed by the judge granting them visitation and custody rights to their child, and until such order is issued, unmarried father's have no rights. Legal custody and Physical custody will be established, along with parenting time and child support. Children under the age of 18 years of age cannot "pick" or "decide" with which parent they want to live with. The judge decides custody until they are adults.
